These Terms of Service ("Terms") govern your use of CallRelayHQ ("Service"), operated by CallRelayHQ ("we," "us," or "our"). By creating an account and using our Service, you agree to these Terms.

    Important: CallRelayHQ provides AI-powered voice assistance. The AI may make mistakes. You are responsible for verifying all property information and ensuring compliance with real estate laws in your jurisdiction.
  

1. Description of Service

CallRelayHQ provides an AI voice receptionist service for real estate agents. The service creates an AI-powered phone agent that answers inbound calls, provides property information, and captures lead information on your behalf.

2. Account Registration

To use CallRelayHQ you must:

Be at least 18 years of age
Be a licensed real estate agent, broker, or authorized representative
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized account access

3. Subscription and Payment

CallRelayHQ is a subscription service billed at $350 per month. Your subscription includes:

One AI voice agent configured to your specifications
300 minutes of live AI call handling per month
Access to your agent dashboard with call logs and lead information
Ability to update your listings and agent configuration

Minutes exceeding 300 per month are billed at $0.15 per minute. You will receive an email notification when you reach your monthly limit.

Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You may cancel at any time — cancellation takes effect at the end of your current billing period.

4. Your Responsibilities

By using CallRelayHQ, you agree to:

Provide accurate property listing information to your AI agent
Comply with all applicable real estate laws and regulations in your jurisdiction
Comply with all applicable call recording disclosure laws — you are responsible for notifying callers that their call may be recorded as required by law
Not use the service for any unlawful purpose
Not attempt to manipulate, deceive, or misuse the AI system
Promptly update your listing information when properties are sold or taken off market
Verify any property details or appointment information that the AI communicates to callers

5. AI Disclaimer and Limitations

    CallRelayHQ's AI agent is not a licensed real estate agent. It is an automated tool that provides information based solely on data you supply. The AI may occasionally make errors, misunderstand questions, or provide incomplete information.
  

You acknowledge and agree that:

The AI agent acts as an automated receptionist, not a licensed real estate professional
All property information provided by the AI is sourced from data you enter — we are not responsible for the accuracy of this information
You are solely responsible for following up on leads and confirming any appointments or information the AI communicates
CallRelayHQ is not liable for any lost business, missed opportunities, or damages resulting from AI errors or misunderstandings
The AI clearly identifies itself as an AI assistant to callers

6. Call Recording Compliance

Call recording laws vary by state and country. Some jurisdictions require all-party consent before recording a phone call. You are solely responsible for complying with applicable call recording laws in your jurisdiction and the jurisdictions where your callers are located. CallRelayHQ is not responsible for any legal liability arising from call recording compliance issues.

7. Prohibited Uses

You may not use CallRelayHQ to:

Violate any applicable laws or regulations
Harass, deceive, or defraud callers
Provide false or misleading property information
Impersonate another person or entity
Collect information from callers without appropriate disclosure
Use the service for any purpose other than legitimate real estate business

8. Intellectual Property

CallRelayHQ retains all rights to our platform, technology, and software. You retain ownership of the property listing data and business information you provide. You grant us a limited license to use your data solely for the purpose of operating your AI agent.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, technical issues, or third-party service disruptions may occasionally affect availability. We are not liable for any damages resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, CallRelayHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost commissions, or lost business opportunities, arising from your use of the service. Our total liability to you for any claims arising from these Terms or the service shall not exceed the amount you paid us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold CallRelayHQ harmless from any claims, damages, or expenses (including attorney fees) arising from your use of the service, your violation of these Terms, or your violation of any applicable laws.

12. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your AI agent will be deactivated and your data will be retained for 30 days before deletion unless you request earlier deletion.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
